01   Who We Are and What This Covers

This Privacy Policy describes how 20 Majors, LLC and our affiliates and subsidiaries (collectively, “we,” “us,” or “our”) collect, use, and share information when you visit or interact with our websites.

This Policy applies to the following properties, together with any other website, online store, or web application operated by us that links to this Policy (collectively, the “Sites”):

• Nicklaus.com, including its blog, editorial content, and subdomains
• shop.nicklaus.com, our online store
• NicklausDesign.com
• Individual golf course and club websites operated by us or on behalf of our affiliated courses and clubs that display or link to this Policy

In addition to this Policy, users of the Sites should review the Terms and Conditions of Use.  By using the Sites, you acknowledge the practices described in this Policy, and you agree to be bound by the Terms and Conditions of Use. If you do not agree with this Policy or Terms and Conditions of Use, please do not use the Sites.  

Note for individual course websites: some affiliated courses and clubs may collect additional information through their own reservation, membership, or tee time booking systems operated by third parties. Where that occurs, the third party’s own privacy policy also applies and will be linked at the point of collection.

02   Information We Collect

INFORMATION YOU PROVIDE DIRECTLY

• Contact and inquiry information: name, email address, phone number, company, and message contents when you submit a contact form, request information about course design services, membership, events, or partnerships, or otherwise correspond with us.
• Newsletter subscriptions: email address and, where requested, name and preferences when you sign up for our newsletters or updates.
• Purchase information: name, email, billing and shipping address, phone number, and order details when you make a purchase on our online store. Payment card details are collected directly by our payment processor and are not stored on our servers (see Section 5).
• Account information: credentials and profile details if you create an account on any of the Sites.
• Event and booking inquiries: information you submit in connection with outings, events, club membership interest, or tee time requests on affiliated course websites.
• Employment applications: resume and application details if you apply for a position through the Sites.

INFORMATION COLLECTED AUTOMATICALLY

• Device and usage data: IP address, browser type, operating system, device identifiers, referring URLs, pages viewed, links clicked, and the dates and times of your visits.
• Cookies and similar technologies: as described in Section 4.
• Server logs: standard web server logs maintained by our hosting providers for security and performance purposes.

INFORMATION FROM OTHER SOURCES

We may receive information about you from our affiliates, business partners, social media platforms when you interact with our official accounts, and publicly available sources, and we may combine it with information collected through the Sites.

03   How We Use Information

We use the information we collect to:

• Operate, maintain, and improve the Sites and our products and services
• Process and fulfill orders, returns, and customer service requests
• Respond to inquiries about course design, membership, events, partnerships, and media
• Send newsletters, marketing communications, and updates you have requested or that we believe may interest you, subject to your right to opt out
• Analyze how visitors use the Sites so we can improve content, navigation, and performance
• Personalize content and remember your preferences
• Detect, prevent, and respond to fraud, abuse, security incidents, and technical issues
• Comply with legal obligations and enforce our terms and policies
• Evaluate and complete corporate transactions such as mergers, acquisitions, or asset sales

04   Cookies and Analytics

The Sites use cookies, pixels, and similar technologies. Cookies are small text files placed on your device that help the Sites function and help us understand how they are used.

CATEGORIES WE USE

• Strictly necessary cookies: required for core functionality such as page navigation, shopping cart, checkout, and security. These cannot be switched off through our tools.
• Analytics cookies: we use Google Analytics 4 to understand visitor traffic and site usage. Google Analytics collects information such as IP address (which may be truncated or anonymized), pages visited, and session activity. You can learn how Google uses this data at policies.google.com/technologies/partner-sites and opt out using the Google Analytics Opt-out Browser Add-on at tools.google.com/dlpage/gaoptout.
• Functional cookies: remember choices you make, such as region or preferences, to provide a more tailored experience.
• Advertising and social media cookies: where present, these are set by third-party platforms (such as embedded video players or social sharing tools) and may be used by those platforms to build a profile of your interests.

YOUR CHOICES

Most browsers let you refuse or delete cookies through their settings. Blocking some cookie types may affect how the Sites work, particularly checkout on our online store. Where required by law, we will request your consent to non-essential cookies through a banner or preference tool before they are set.

05   Payments and Online Purchases

Purchases on shop.nicklaus.com and any other commerce features on the Sites are processed by Stripe, Inc. When you enter payment card information, it is transmitted directly to Stripe over an encrypted connection. We do not receive or store your full card number, expiration date, or security code. We retain order records, including the items purchased, amounts, shipping details, and the last four digits of the card used, for fulfillment, customer service, accounting, and fraud prevention.

Stripe processes your payment information in accordance with its own privacy policy, available at stripe.com/privacy, and is certified to PCI DSS standards.

06   Service Providers We Use

We rely on a small number of carefully selected service providers to operate the Sites. These providers process information only on our behalf and under contractual obligations to protect it. The table below lists the principal categories in use as of the Effective Date.

We may add or replace providers from time to time. Where a change materially affects how your information is handled, we will update this Policy.

07   When We Share Information

We do not sell your personal information for money. We share information only in the following circumstances:

• Within our corporate family: among our affiliates and subsidiaries for the purposes described in this Policy.
• Service providers: with the vendors listed in Section 6 and similar providers who perform services on our behalf.
• Affiliated courses and clubs: if you submit an inquiry on an individual course website, with the relevant course or club so it can respond to you.
• Legal compliance: when required by law, subpoena, or legal process, or to protect the rights, property, or safety of our company, our users, or others.
• Business transfers: in connection with a merger, acquisition, financing, reorganization, or sale of assets, in which case information may be transferred as a business asset.
• With your consent: in any other case where you direct or agree to the sharing.

Please note that some state privacy laws define “sale” or “sharing” broadly enough to include certain cookie-based analytics or advertising activity. To the extent any such activity on the Sites qualifies, you may opt out as described in Sections 8 and 15.

08   Your Privacy Rights

Depending on where you live, you may have some or all of the following rights with respect to your personal information:

• Access: request confirmation of whether we process your personal information and obtain a copy of it.
• Correction: request that we correct inaccurate personal information.
• Deletion: request that we delete personal information we hold about you, subject to legal exceptions.
• Portability: receive your personal information in a portable, readily usable format.
• Opt out: opt out of targeted advertising, the sale or sharing of personal information, and certain profiling, to the extent those activities occur.
• Non-discrimination: exercise your rights without receiving discriminatory treatment.

To exercise any of these rights, contact us using the details in Section 17. We will verify your request using the information associated with your interactions with the Sites and respond within the time required by applicable law. You may designate an authorized agent to submit requests on your behalf where permitted. If we decline a request, you may be entitled to appeal by replying to our decision, to which we will explain the outcome of the appeal.

09   International Visitors

The Sites are operated from the United States, and information we collect is processed and stored in the United States, where privacy laws may differ from those in your country.

If you visit the Sites from the European Economic Area, the United Kingdom, or Switzerland, we process your personal data on the following legal bases: performance of a contract (for example, fulfilling an order), our legitimate interests in operating and improving the Sites and communicating with business contacts, your consent (for example, for newsletters and non-essential cookies), and compliance with legal obligations. You have the rights described in Section 8 as well as the right to withdraw consent at any time and to lodge a complaint with your local supervisory authority. Where we transfer personal data internationally, we rely on appropriate safeguards such as standard contractual clauses entered into by our service providers.

10   Email Communications

If you subscribe to a newsletter or provide your email in connection with a purchase or inquiry, we may send you marketing and informational emails. Every marketing email we send includes an unsubscribe link, and you may opt out at any time by using that link or by contacting us directly. We will continue to send transactional messages, such as order confirmations and shipping notices, which are not subject to marketing opt-outs. We comply with the CAN-SPAM Act and applicable anti-spam laws.

11   Children’s Privacy

The Sites are intended for general audiences and are not directed to children under the age of 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided personal information through the Sites, please contact us and we will delete it. Where a course or program affiliated with us collects information about junior golfers, that collection is handled through dedicated registration processes with appropriate parental consent, not through the Sites.

12   Data Retention

We retain personal information for as long as reasonably necessary to fulfill the purposes described in this Policy, including providing services, maintaining business and financial records as required by law, resolving disputes, and enforcing agreements. Retention periods vary by the type of information: for example, order records are kept for tax and accounting periods required by law, newsletter subscriptions are kept until you unsubscribe, and analytics data is retained according to the settings of our analytics provider. 

13   Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information, including encrypted connections (HTTPS) across the Sites, access controls, and reliance on established infrastructure providers. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If we become aware of a breach affecting your personal information, we will notify you and regulators as required by applicable law.

14   Links to Other Websites

The Sites contain links to websites we do not operate, including partner brands, retailers, media outlets, booking platforms, and social media. This Policy does not apply to those websites, and we are not responsible for their privacy practices. We encourage you to review the privacy policy of any website you visit.

15   Do Not Track and Opt-Out Signals

Some browsers transmit “Do Not Track” signals, for which no industry standard has been adopted; the Sites do not currently respond to those signals. Where required by applicable state law, we honor the Global Privacy Control (GPC) signal as a valid request to opt out of the sale or sharing of personal information for the browser or device on which it is enabled.

16   Changes to This Policy

We may update this Policy from time to time to reflect changes in our practices, technology, or legal requirements. When we do, we will revise the “Last Updated” date at the top of this page, and for material changes we will provide additional notice, such as a statement on the Sites’ homepages or an email to subscribers. Your continued use of the Sites after an update constitutes acceptance of the revised Policy.  We encourage you to check for updates on this Policy when you visit the Sites.
